REAL ESTATE PHOTOGRAPHY AND MEDIA AGREEMENT
Acadiana Property Pics Lafayette, Louisiana
By booking services with Acadiana Property Pics, the client agrees to the following terms and conditions.
SERVICES AND DELIVERY
Acadiana Property Pics provides professional real estate photography and media services as scheduled. Standard real estate photographs and virtual twilight images will be delivered within 24 hours of the completed photography session, subject to the conditions outlined in this agreement.
PAYMENT AND DEPOSITS
Full payment is required before high-resolution, unwatermarked media files are released. Final media will be provided through a secure online delivery portal and will remain locked or watermarked until payment is received.
Acadiana Property Pics reserves the right to require a partial deposit or full payment in advance from first-time clients to secure an appointment.
TRAVEL FEES
Travel fees are calculated based on driving distance from Lafayette, Louisiana.
Travel within 50 miles has no additional charge.
Travel over 50 miles and up to 75 miles incurs a flat fee of $40.
Travel exceeding 75 miles incurs a $40 flat fee plus $0.78 per additional mile beyond 75 miles.
Applicable travel fees will be added to the order total.
CANCELLATIONS AND RESCHEDULING
Cancellations or rescheduling requests made less than 72 hours before the scheduled appointment will incur a $50 fee. Clients are responsible for providing advance notice of any scheduling changes.
WEATHER, LIGHTING AND DRONE SERVICES
Weather, natural lighting, cloud cover, and precipitation may affect the appearance and quality of photography and virtual twilight images. Acadiana Property Pics reserves the right to delay or reschedule outdoor services when conditions prevent professional-quality results.
Drone photography and video are subject to weather conditions, safety requirements, and FAA regulations. If drone services cannot be safely or legally completed, the drone portion will not be charged. All other scheduled services and applicable terms remain in effect.
PROPERTY PREPARATION AND CONDITIONS
Properties must be clean, staged, accessible, and photography-ready before the scheduled appointment. Acadiana Property Pics is not responsible for cleaning, staging, or moving furniture or personal belongings.
Properties without working electricity, functioning utilities, adequate lighting, or in significant disrepair may result in reduced media quality. Acadiana Property Pics is not responsible for quality limitations directly caused by these property conditions.
COPYRIGHT AND MEDIA LICENSING
Acadiana Property Pics retains full copyright and ownership of all photographs, videos, aerial footage, and other media produced.
The purchasing client receives a limited, non-transferable, single-listing license to use the media solely for marketing the specified property listing.
Media may not be sold, transferred, or licensed to third parties without written authorization. Builders, designers, stagers, architects, contractors, subsequent listing agents, or other third parties must contact Acadiana Property Pics to purchase a separate usage license.
GEOGRAPHIC SERVICE RESTRICTIONS
Acadiana Property Pics provides services exclusively within the United States and does not accept bookings or provide services for properties or business transactions located outside the United States.
GOVERNING LAW, LIABILITY AND DISPUTES
This agreement is governed by the laws of Louisiana. To the extent permitted by applicable law, disputes arising from these services must be brought in a court of competent jurisdiction in Lafayette Parish, Louisiana. Clients, including those located outside Louisiana, consent to personal jurisdiction in those courts.
To the extent permitted by law, Acadiana Property Pics' total liability for claims related to a photography session shall not exceed the amount paid for that specific session. Acadiana Property Pics is not liable for indirect, incidental, or consequential damages, including lost listing revenue or profits.
In any legal action arising from this agreement, the prevailing party may recover reasonable attorney's fees and court costs to the extent authorized by applicable law.
ACCEPTANCE OF TERMS
By submitting an order or booking a photography session, the client acknowledges that they have read, understand, and agree to these terms and conditions, including payment requirements, cancellation policies, property preparation responsibilities, copyright restrictions, and media licensing requirements.
